These Text Messaging Terms and Conditions (“Terms”) govern your participation in the SMS/MMS text messaging program (“Program”) offered by ZCK Enterprises, LLC d/b/a Visionary Funding (“Visionary Funding,” “we,” “us,” or “our”). By opting in to the Program, you agree to these Terms.

1. The Program

The Program is used to send you informational text messages related to your pre-settlement funding application and/or account, which may include:

  • Application and funding status updates
  • Requests for documentation
  • Payment, payoff, or payback confirmations
  • Customer service and account-related communications

The Program is not a marketing or promotional messaging list; messages relate to your specific application or account with Visionary Funding.

2. Eligibility and Opt-In

You must be at least 18 years old and the owner or authorized user of the mobile number provided to participate in the Program. You may opt in by providing your mobile number and consent through our website intake form, over the phone, or in writing in connection with your funding application. By opting in, you consent to receive text messages from Visionary Funding at the mobile number provided, including messages sent using an automatic telephone dialing system.

Consent to receive text messages is not a condition of purchasing any goods or services from Visionary Funding.

3. Message Frequency

Message frequency varies based on your application and account activity. You can generally expect up to 50 messages per application process.

4. Message and Data Rates May Apply

Message and data rates may apply to any text messages we send or that you send to us. Message and data rates are determined by your wireless carrier and mobile plan. Contact your wireless carrier for details on your plan.

5. Opting Out (Cancellation)

You may cancel the Program at any time. Text STOP to the number from which you received messages. After you send STOP, we will send you a one-time message confirming your unsubscription. You will no longer receive text messages from that number. If you wish to rejoin the Program, sign up as you did the first time and we will start sending text messages to you again.

Carriers are not liable for delayed or undelivered messages. Participating carriers include major U.S. wireless carriers. Carrier coverage and reliability is not guaranteed and may vary by carrier and location.

8. No Warranty

The Program is offered on an “as-is” basis. We do not guarantee delivery or timeliness of any text message. We are not liable for delayed or undelivered messages, or for any errors or interruptions in the Program.

Our collection and use of information in connection with the Program is governed by our Text Messaging Privacy Policy, and our general Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued participation in the Program after changes are posted constitutes acceptance of the updated Terms.
